Membership Terms & Conditions

1. Who we are
Football For Fat Loss ("we", "us") is run by Football for Fat Loss Ltd, a company registered in England (company number 16976557), registered office 23 Horsebridge Road, Havant, PO9 2LH. For anything about these terms or your membership, email info@footballforfatloss.com or write to us at 23 Horsebridge Road, Havant, PO9 2LH. These terms, together with the club rules (footballforfatloss.com/rules) (the Club Rules) and privacy notice (footballforfatloss.com/privacy), are the agreement between you and us when you become a member (the Agreement).
2. Becoming a member and registration process
2.1You must be 18 or over to join.
2.2New players join with a BMI of 27.5 or above (see the Club Rules) as this is a weight-loss league, and the entry gate keeps it fair.
2.3To become a member you must apply through our website by completing an online membership application form (footballforfatloss.com/signup) (the Application Form). You will be required to create an account with us using your email address, including creating a password of your choice, after which time your own personal information can only be accessed by means of your email address and the password provided as part of the Application Form.
2.4You are not permitted to register or create more than one account with us on our website.
2.5Your membership and this Agreement commences and becomes legally binding on you and us when we confirm your membership and assign you a team in writing (the Commencement Date). After we have confirmed your membership in writing, you will then be required to complete a health questionnaire (the Health Questionnaire) and set up your Direct Debit payment details with us, for us to take the first monthly payment in accordance with clause 4.3. If you do not set up your Direct Debit payment with us within seven days of us confirming membership, we may cancel your membership and release your place to the waiting list.
2.6We may decline or delay an application for membership where we reasonably believe taking part would not be appropriate for you, for example on capacity, eligibility or safety grounds. If we decline your application for membership, we will notify you in writing and any payment made to us shall be refunded to the UK bank account details provided within 14 days of the date of our notice.
2.7You must make sure that all of the details you give us during the membership application process, including in the Application Form and the Health Questionnaire, are accurate and complete.
2.8You are responsible for keeping your password confidential and for all use of your registered account, regardless of whether such use is authorised or not. You shall immediately inform us of any unauthorised use of your account.
3. Your health — This is important
3.1We are a football club, not a medical organisation. Nothing we provide as part of our service, including weigh-in data, BMI figures and progress charts, is medical advice.
3.2You must make sure you are capable of safely participating in a session, taking into account your fitness level, strength, any health conditions, weaknesses, injuries or illnesses you have (or have had in the past). Speak to your GP before starting any weight-loss or exercise programme if you have any doubt about your health, and tell the Coach about any injury or condition that could affect you playing before the start of any session. If there are any changes in your health, fitness level or strength (including recent illnesses, injuries and new or worsened health conditions) it is your responsibility to decide whether to continue participating in a session. Our staff, including the Coach, are not authorised by us to advise whether you are capable of safely participating in a session, and you should not rely on any advice given by them.
3.3By joining you confirm the information you give us is accurate, that you shall keep it up to date, and that you consider yourself able to take part in the sessions. All sport carries a risk of injury and all members take part voluntarily at their own risk.
3.4You must report any accident or injury you incur during any of our sessions to the Coach at the session or by emailing us at info@footballforfatloss.com within seven days of the session date where the accident or injury occurred.
4. Fees and payment
4.1Membership fees include the following:
4.1.1a one-off joining fee of £10.00 (if payable) (the Joining Fee); and
4.1.2subject to clause 4.6, a monthly fee of £29.95 (the Monthly Fee),
with all fees collected by Direct Debit through GoCardless. You are protected by the Direct Debit Guarantee, and we never see or store your bank details.
4.2The first 25 members registered with us shall not be required to pay the Joining Fee.
4.3The first collection of the Joining Fee (if payable) and Monthly Fee is taken as soon as possible after the Direct Debit payment details are provided to us and set up in accordance with clause 2.5. The second Monthly Fee shall be collected one month after this date, with subsequent Monthly Fees collected monthly thereafter. All Monthly Fees shall be payable and collected in advance for an upcoming month.
4.4If any Direct Debit collection fails, we will notify you and retry. If the payment is not put right and received by us within 14 days of our notice, we may end your membership and this Agreement under clause 8 and notify you that we have done so.
4.5All Joining Fees and Monthly Fees are inclusive of any VAT payable.
4.6BMI Boss rate. If your BMI, as measured at our weekly session weigh-ins, is below 25 for four consecutive weekly sessions, you qualify for a £10.00 reduction to the then-current Monthly Fee. The reduced Monthly Fee applies from the next Monthly Fee collection date. If your BMI is 25 or above at four consecutive weekly sessions, or you stop attending weekly session weigh-ins, the standard rate resumes from the next Monthly Fee collection date. Club weigh-in records are final. Any issues with such records must be raised at the time of the weigh-in with the Coach. The reduction cannot be combined with other discounts in the same month (including those referred to under clause 4.7), is not transferable, and has no cash value. The Club may amend or withdraw the rate for future qualifying periods by notifying you by email at least one month in advance, without affecting a reduction already in payment.
4.7Monthly Fees may be subject to promotional discounts as published on our website from time to time. Any such promotional discounts shall be at our sole discretion and are not guaranteed.
4.8If we change the Monthly Fee we will tell you by email at least one month in advance. The new amount only ever applies from a future Monthly Fee payment date, and you can cancel before it takes effect. If you do not cancel your membership by the date given to you in the notice on which the change in Monthly Fee takes effect, then your membership will continue and the price of your Monthly Fee will be automatically increased in accordance with our notice.
4.9Unless you are cancelling our membership under clause 5 or clause 6, the Joining Fee (if payable) during the first month, and any Monthly Fee, are non-refundable. Sessions are a group activity. If you are unable to attend a session in any week, we are unable to rearrange the session or refund any part of your Joining Fee (if payable) during the first month, or Monthly Fee, for non-attendance.
5. Your right to cancel (14-day cooling-off)
5.1You can cancel within 14 days of the Commencement Date your membership, without giving a reason, by emailing info@footballforfatloss.com. We shall refund what you have paid within 14 days of you telling us.
5.2If you ask to participate in any sessions during those 14 days, we shall deduct a fair amount for the sessions you have asked to participate in from the refund before your cancellation.
6. Cancelling later — no lock-in
6.1Membership runs month to month from the Commencement Date with no minimum term. Therefore you may cancel any time, without giving a reason, by emailing info@footballforfatloss.com. Your membership shall automatically end on the day before your next Monthly Fee payment date, and no further collections shall be taken.
6.2Cancelling your Direct Debit at your bank also stops your membership, but an email helps us free your place for the waiting list promptly.
6.3If we receive your notice to cancel your membership whilst a collection of an upcoming Monthly Fee is already in process, it may still be taken on the next Monthly Fee payment date. If so, your membership shall run to the end of that paid month, or we can refund the Monthly Fee if this is your preference and you let us know by emailing info@footballforfatloss.com.
7. What we expect from you
In addition to complying with your obligations under clauses 2, 3 and 4, we expect you to follow and adhere to the Club Rules and any safety instructions given at sessions by our staff and the Coach. The Club Rules' discipline section applies on the night; behaviour that puts others at risk, including violence, discrimination, repeated serious breaches, can lead to us ending your membership under clause 8.
8. When we can end your membership
8.1We can end your membership with written notice if you seriously or repeatedly breach this Agreement or the Club Rules, or if a payment fails and is not put right within 14 days of us letting you know.
8.2If we end the Agreement in the situations set out in clause 8.1 we will refund any money you have paid in advance for sessions we have not provided but we may deduct or charge you for any reasonable costs that we have incurred up to that point as a result of your breach of the Agreement, including for the sessions you have participated in during that month from the refund.
9. Limitation of our liability — This is important
9.1Nothing in this Agreement excludes liability we are unable to exclude by law, including for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
9.2Subject to clause 9.1, we are not liable for:
9.2.1losses that were not foreseeable when you joined or as a result of our breach of this Agreement. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the Agreement was made, both we and you knew it might happen, for example, if you discussed it with us during the membership process;
9.2.2losses not caused by us breaching this Agreement;
9.2.3business losses, including loss of profit, loss of business, business interruption or loss of business opportunity;
9.2.4loss or damage to personal belongings at the venue during a session; or
9.2.5losses arising from events outside our reasonable control, including venue closure, weather, strikes and pandemics, which stops a session or affects the service.
10. Your data
10.1We will use your personal information you provide us to:
10.1.1supply our services to you, including recording your BMI and weight-loss progress;
10.1.2process your payment of the Joining Fee (if payable) and Monthly Fees; and
10.1.3if you agreed to this during the membership process, to give you information about other memberships or services that we provide, but you may stop receiving this at any time by contacting us.
10.2We will not give your personal information to third parties unless the law either requires or allows us to do so.

11. General
11.1If you are unhappy with anything, please contact us first at info@footballforfatloss.com.
11.2These terms and the Agreement are governed by the law of England and Wales and you can bring legal proceedings in respect of this Agreement in the English courts.
11.3Only you and us can enforce the terms of this Agreement. No one else shall have any rights to enforce any of its terms.
11.4If we make a material change to the terms of this Agreement we will tell you by email before it takes effect.
11.5We may transfer our rights and obligations under the terms of this Agreement to another organisation. We will endeavour to tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the Agreement.
11.6Each of the clauses of this Agreement operate separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses will remain in full force and effect.
11.7If we do not insist immediately that you do anything you are required to do under this Agreement, or if we delay in taking steps against you in respect of you breaching this Agreement, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
